Far be it from me to condone impunity. We all know that what happened after the elections was one of the most devastating events to have occured in Kenya. In a perfect world, it would be wise and prudent to ferociously come after the men who orchestrated the mayhem that was visited on Kenyans. But this is not a perfect world. In deciding to walk away from the Waki findings, our elected leaders took only one thing into consideration...the impact of implementing the report.
There were two possible outcomes here:
1. By trying to implement this monster, the gentlemen who have been adversely mentioned in the report would not have taken it lying down. So what, you ask? Well, have you considered that these men are at the helm of tribal chieftaincies? Have you considered that as of now they retain the influence to destabilize major parties...and by extension the nation? That is a fact we can't just wish away. So if we come after these men we risk antagonizing whole communities and creating another round of ill feeling at a time when Kenya is evidently healing.
Let the healing prevail.
2. The other outcome would be that we drive the nails in the coffins of these guys and let nature take its course. If Kenya ignites afresh in an orgy of bloodletting, so be it. The problem with that thinking is that it undermines the peace we've worked hard to restore. I don't care what the U.S. and the German ambassadors say. What I know for sure is that when Kenya ignites, they'll send in American and German planes to whisk their nationals to safety. We don't have the luxury of listening to their misguided sermons. In anycase, when was the last time you heard ambassador Ogego tell the Americans how to run their affairs? And when was the last time you saw any of our ambassadors pretend to understand somebody's country better than the people who were born and bred there?
I detest the role these two men have played since the debacle that was our elections. I may disagree with Vice President Kalonzo Musyoka on other matters, but on this one I call on Kenyans to heed his advice...let's not open another can of worms foolishly. We must proudly take out matching orders from our understanding of our issues, our background and how they affect us. That's why we have brains.

Flipping through TV channels this evening was fascinating for those Kenyans who are in Kenya or able to gain access to Kenyan TV stations.
On NTV constitutional law guru Prof Yash Pal Ghai praised the Waki report (as a lawyer and expert). While on KTN Budalangi legislator, Ababu Namwamba who is also a lawyer defended the ODM position in joining PNU in rubbishing the Waki report.

The most fascinating thing here is the reaction of the majority of Kenyans mainly as could easily be gauged from sampling those who called in. It was clear that there is great anger against those who are rejecting the Waki report and by extension saying YES to impunity and its’ survival in the country’s political landscape. One caller put it very clearly when they said that it was unfair for the political class to reject the Waki report to protect their own when many ordinary Kenyans are still languishing in jail as suspected participators in the post election mayhem. So is this the justice that the political class are promoting in rejecting the Waki report?
Take note fellow Kenyans in all this sordid affair of the reaction of the political class to the Waki report, something has happened. A clear shift has taken place in the political stratosphere. This is the beginning of the end of old politics in Kenya. This is the end of ODM. This is the end of PNU. And most of all this is the end of impunity. Let us wait and see what will happen.

US Elections Necessitates High Terror Alert in Kenya

Senator Barack Obama’s grandmother Sarah Hussein Obama during a past interview with the press at her Nyang’oma Kogelo village in Siaya. The press has been barred from the home until Nov 5 to give her a break from constant media engagements.
Latest news in Kenya indicate that the Kogelo based family of US Democratic presidential candidate Barack Obama has halted all media engagements until after the US presidential election on November 4 . According to the reports, the move has been taken to give Obama's paternal step grandmother, Mama Sarah Onyango Obama a break, so says spokesperson thura Said Obama.
However, and contrary to this information, the REAL reason for curtailing press interviews and effectively ring-fencing Mama Obama are far much more serious. Coming soon after a personal and unannounced visit to the homestead by ODM party leader Raila Odinga, whereby closed door meetings were held between Raila and Mama Sarah, it appears the grand coalition government does not want to take any chances. Although the family is promising to open up to the public after the elections, it is highly unlikely the jovial Kogelo villagers will ever again step into the currently-under-tight security-Obama-homestead, let alone see the Obama matriarch at the local market rendezvous, given that Obama has very high chances of emerging the winner against John McCain. (Make that a landslide!).
Information reaching this blogger indicates that Kenyan and regional security forces, working closely with American Secret Service and FBI, have put all exit points out of Kenya on HIGH ALERT following credible intelligence information indicating that the Al-Qaeda terrorist cell in Eastern Africa under the leadership of 10 years-yet- to- be arrested- Harun Fazul is planning a terrorist attack on local vital installations and Western interest in the Eastern Africa region. Mama Sarah is, according to intelligence sources, an obvious and vulnerable target!!!! Infact, the IGAD summit on Somalia taking place in Nairobi today is just but a smokescreen to have the Heads of State/Government confer one-on-one and face-to-face on the serious security threats arising out of the imminent Barrack H. Obama presidency in the U.S.
Interestingly, even the normally vocal and social US Ambassadors in the region (including our very own MR in Kenya) have ‘gone underground’ because the threats of attack are allegedly already in advanced stages and are aimed at petrol stations (forecourts in Western lingo) oil tankers and airports and other strategic interests. The attacks are allegedly planned to coincide with the US Presidential Elections in early November when the global attention will be singularly focused on witnessing the elections of a candidate whom the Al Qaeda are not supporting because his victory will mean end of the war. Not surprisingly, the public concentration in Kenya is expected to reach the same levels or perhaps exceed what was witnessed in December 2007 during the country’s own presidential elections.
As it is, the Al Qaeda group is reportedly already IN-REGION crisscrossing the borders and mingling with common mwananchi with intentions of identifying escape routes and camouflage.
Security has therefore been enhanced to an unprecedented level at all regional seaports, airports and border points while anti-terrorism vigilance is a step or two higher than usual. Accordingly, customs, immigration and security officers are having sleepless nights as we approach the D-day in the US.
It may surprise many that a peasant granny in poverty-stricken, AIDS ravaged Nyanza Province of Kenya is now centre of global attention and supposedly a terrorist target, but this is what being President of the United States of America means.

You don’t have to be a neurosurgeon to see the thinly veiled cry now that Waki saw it coming and sealed all rent-seeking loopholes. Jitters In Kenyan Kitchen Cabinet Over An Obama Win

But are they really justified?
Insider sources inform this blogger that when the possibility of an Obama win was first brought up within the Kibaki kitchen cabinet months ago, it was dismissed outright. Somebody confidently predicted that Sanetor Hillary Clinton would win the Democratic party nomination to run for the presidency and that she would do it easily. Most of the old school members of this inner circle have visited the United States many times and some have even lived there and so they were pretty confident with their predictions. The general feeling was that there was no way the racially charged Americans could elect Barack Obama.
Well now there are serious jitters within this inner circle even as they remain completely puzzled and dumbfounded as to what the hell is going on. How can that son of a “Jaruo” rise to be president of the most powerful nation in the world? HOW???
In fact if I could talk to them I would tell them something else to completely bawl them over. My insider source in America (with decades of experience observing the politics in that country) told me last night that it is now looking like the first time Illonois Senator will win the presidency by a landslide. YES, I was stunned myself at this information and I still am.
But why should any Kenyan in their right mind not be happy at the prospect of the son of a Kenyan from Siaya becoming president of the most powerful nation on earth? The answer can be found in the complex cut-throat game of politics.
You see despite the so called Grand coalition government, the truth is that both the PNU and ODM factions within the coalition are still bitter rivals looking for the upper hand that will carry the day when the next general elections are called. It is no secret that the man who could be the next President of the United States has some very close ties with the ODM top brass. One just needs to cast their mind back to the Obama visit last year and the feathers it ruffled in the then Kibaki government to realize what I am talking about here. Don’t forget that President Kibaki flatly refused to meet with Senator Obama during that memorable visit. Now if Obama lands in the White House, roles will be reversed and it will be president Kibaki seeking audience with Obama.
And that is in a scenario where Prime Minister Raila Odinga regularly has cell phone conversations with Obama. Naturally this makes many within the president’s inner circle very jittery and hoping against all hope for some miracle that will see John McCain somehow winning.
What worries PNU insiders is that the president of the most powerful nation is well able to make decisions that could greatly jeopardize their well laid plans. In fact those jitters extend to most of the political class and those who have made their money through dubious means.

What Was Your Role In The Mayhem, Mr President?

Water Minister Charity Ngilu has a long history and reputation for speaking her mind and not caring too much about the consequences.
Now she is asking a very simple but direct question. What was the role of President Mwai Kibaki in the post election violence? Now before the tribalists come out heaving and breathing fire, let us pause for a moment of quiet sober and non-partisan reflection.
Kenyans are unanimous in agreeing that there should be no amnesty and that all perpetrators of post election violence should face the full force of the law. That is fine. But please remember that already many innocent Kenyans are languishing in jail for mostly being at the wrong place at the wrong time. And this was mostly because they happened to be poor. Quite a number of the guilty ones are already dead and some are already answering to their heinous acts in the courts. And all this is going on when none of the people right at the centre of triggering the whole mess are roaming the country scot free. Some of these people are now loudly asking for amnesty.

My nasty toothache experience

Folks please let us learn how to be a little sensitive. Imagine what those Kenyans who suffered greatly as a result of the skirmishes feel when they hear the word “amnesty.” Those whose nothers. Sisters, wives and girl friends were brutually raped. Those whose loved ones were killed as they watched. Have mercy. Don’t you think that the call for amnesty is making them live through the nightmare all over again?
We said in this blog very early on that election violence perpetrators should either all be prosecuted or all given amnesty. In other words there should not be any selective justice. Especially if that justice is meted out Kenya-style where there is a very different way of handling the poor while the rich mined and political class can never seem to be touched by the same law.
Now the truth of the matter is that the whole post-election violence horrors were triggered off by a stolen election. So justice must start where the problem started surely. What makes this whole thing even sadder is the fact that those close to the president and indeed the president himself were fully briefed (if we are to believe the NSIS) on the consequences of election theft. But still they went ahead and to make matters worse, without taking the necessary precautions to limit the loss of human life. Indeed there is evidence to suggest that certain arms of the security forces deliberately went out to kill, the objective being to scare demonstrators and other would-be trouble makers from escalating the violence. Well this plan fell flat on its’ face and what saddens me the most is the fact that one of the reasons why this happened was that those making decisions had no idea at all where the masses of Kenya are coming from and the kind of suffering going on within the borders of our beautiful country just because of impunity and bad politics.
So Mr President, even as you suddenly shift gears about this amnesty thing, please tell us, what was your role in the post election violence. Plenty of innocent blood belonging to Kenyans is crying out from the ground for an answer to that question.
Again I ask, what was your role Mr President?

WAKI Report: The Perpetrators of the Ethnic Skirmishes must be brought to Book

The fact that the findings of the Waki team have revealed some very incriminating evidence against leaders in both PNU and ODM, is a very clear indicator that the mayhem that engulfed Kenya early this year was meticulously planned by the rich political and business elite. And as the saying goes, ‘The guilty ones are always afraid’. This explains why some politicians are in an inexpressible state of panic while others have in no uncertain terms trashed the Waki report.
In as much as it is important to forget the past and think of how best to ‘build a New Kenya’ , it is also imperative that we bring to book both the financers and the perpetrators of the atrocious acts for, if we let them go scot free, that would be tantamount to sowing seeds of impunity. It is no doubt that gross crimes against humanity were committed and all the people who aided and abetted the murderers, regardless of their stations in life, must be tried by an International Tribunal.
Every right thinking kenyan should therefore call upon President Kibaki and Premier Raila not to allow the tempering of justice with forgiveness. Everyone must carry their own cross. We must not allow ourselves to be blinded by barbarism and stupid ethnicity. It is high time that we accepted that Kenya is a multi cultural society and that the basic tenets of true Kenyanness lies not in our tribes but in our resolve to invalidate all stupid value systems that are aimed at dividing us along tribal lines. It is time that we understood that our Luoness, Kambaness, Turkananess or Mijikendaness is nothing but a biological accident for, nobody, even the high and mighty sent a telegram or an sms to the Creator asking Him to create them in this or that tribe.
Folks, we must not allow the barbaric philosophies of politicians to fill our heads with negative ethnicity, abhorrence and bloody pettiness. We must understand that politicians play the tribal card to their advantage and not for the benefit of the poor youths who kill and maim at their behest. I would like to pose this sixty four thousand dollar question to all Kenyans: What have we got to show for our barbaric acts? The whole world had held us in such high esteem and we were all proud to be called ‘Kenyans’ before all the hell broke loose. Now, when incidents of utter stupidity and unfathomable barbarism are mentioned anywhere in the world, the Kenyans in diaspora bow their heads in shame as the ethnic cleansing in Kenya is cited as one of the most barbarous and unfortunate incidents to have happened in a civilized country. Fellow countrymen and women, are the people who visited terror on their innocent neighbours not poorer than they were last year? What about the politicians? Has any one of them gone to bed hungry? So, we are fools, aren’t we? If we are not bloody fools, tell me folks, why then did we arm ourselves with all manner of crude weapons and went on the rampage just because some sick barbarians told us to do so? It is an open secret that our blood is sweeter than honey to the politicians who ‘drink’ it and we must say an emphatic “no” to politics of barbarism and blood letting.
It goes without saying that the effects of the post election violence on the economy of this country are unfathomable. Schools, hospitals, roads and railways and farms were destroyed and money that would have been put into better use has to be used to try and clear the mess. How then can we say that these people should be forgiven? If these shameless people are not made to account for their acts, tribal skirmishes will become the norm rather than the exception. We must not allow forgiveness to entrench impunity! The verdict is out; all the murderers and their political godfathers must be tried and punished for their sins.

The Reign of Armed and Uniformed Impunity

As the Waki flame continue to gather more powerful wind, Kenyans are conveniently focused in discussing the post-election violence without pausing to ask the tough and simple question of the root cause. Well, talk is cheap and weak minds are prone to bandy epithets at each other oblivious of the consequences.
Give Kenyans a new constitution that entrenches institutionalized governance and nobody will care a whiff about the tenant at State House. What is more, the respected address will no longer be reduced to a rendezvous for militia planning to murder Kenyans. But that will remain a coloured wish given the aging scoundrels masquerading as our leaders. Last year’s bungled elections only provided the spark that ignited a hitherto simmering time bomb.
The impunity monster that is currently mauling Kenya was conceived by Kenyatta, weaned by Moi and married off to Kibaki. Between these three devils lies two communities who have the highest political stakes and numerous scores to settle. Forget about the Luos, Luhyas and Kambas (not to disparage other 30+ Kenyan tribes). These are three only serve the purpose of completing the quest equation to join to the club. The hatred and occasional embrace accorded to these later three are mostly premised on the Machiavellian doctrine of doing all it takes to demonize a competitor or co-opt as a ladder to the top.
The list in the Wakis’ envelope and the KNHRC original (not the THIRD version) reads likes who is who among the Kikuyus and Kalenjins. It is no coincidence that Jomo Junior tops the list. He has plenty at stake personally and communally and above all else the family name to both protect and expand. And Ruto? Well, the Kikuyus will drop his name in their day time dreams in the belief (real or perceived) that he stand between them and political supremacy.
As much as we would wish to bandage the festering wound, LAND remains the root cause of all the souring political temperatures. Kenyatta grabbed all the prime chunks of Kenya to his fill creating the Kikuyu Diaspora mainly in the rift Valley. Owing to his own insecurity, Moi made unchallenged political supremacy his principal objective for 24 years.
When naive Kenyans thought they had banished personalized selfish rule to hell in 2002 they had no glue that Kibaki had his own unfinished business and dream to fill. Unfortunately that dream was at variance with his voters save for his few supplicants. The rest as they say is history whose text we are painfully living now.
Postponing Armageddon
Times have changed and the Kalenjins will not buy the naive crap of willing-buyer-willing-seller. The superiority complex only helps in boiling the rage. Having both tasted personalized power, the Kikuyus and Kalenjins are simply playing political checkmates. Back to the trenches they will both do anything to reclaim or retain it power. And no price is big enough to pay in that pursuit.
The Kalenjins are (rightly or wrongly) bitter with Kibaki’s orchestrated resolve to cut them to size during his first term as president. On the other hand the Kikuyus are cursing in arrears Moi’s determination to incinerate their hitherto political and economic advantage.
It may sound like a cliche but the truth is that after last years bungled elections Kenya will never be the same again, NEVER. Kibaki’s penchant to resort to the tried and tested political games dolled in stereotypes became his Achilles heels when he underestimated the resolve of Kenyans who know what they want and they are determined to get it at whatever price. The era of using power to selectively reward and punish is gone forever and the sooner the dinosaurs knew that the better.
No amount of uniformed and armed impunity will kill the will of a population determined to regain their right to choose the way they are governed. Only a new constitution reflecting institutionalized governance will save us from the imminent jaws of apocalypse.All else amounts to pretence whose only success is guaranteed in postponing the inevitable.
No wonder Justice Waki's wisdom informed him to ignore the sovereignty balderdash by handing over the secret envelope to Kofi Anna. Message: you can run but not hide.

The hatred and occasional embrace accorded to these later three are mostly premised on the Machiavellian doctrine of doing all it takes to demonize a competitor or co-opt as a ladder to the top.
The list in the Wakis’ envelope and the KNHRC original (not the THIRD version) reads likes who is who among the Kikuyus and Kalenjins. It is no coincidence that Jomo Junior tops the list. He has plenty at stake personally and communally and above all else the family name to both protect and expand. And Ruto? Well, the Kikuyus will spell his name at the drop of a coin in the belief (real or perceived) that he stand between them and political supremacy.
As much as we would wish to bandage the festering wound, LAND remains the root cause of all the souring political temperatures. Kenyatta grabbed all the prime chunks of Kenya to his fill creating the Kikuyu Diaspora mainly in the rift Valley. Owing to his own insecurity, Moi made unchallenged political supremacy his principal objective for 24 years.
When naive Kenyans thought they had banished personalized selfish rule to hell in 2002 they had no glue that Kibaki had his own unfinished business and dream to fill. Unfortunately that dream was at variance with his voters save for his few supplicants. The rest as they say is history whose text we are painfully living now.
Postponing Armageddon
Simply put Kikuyus and Kalenjins have tasted personalized power and will do anything to reclaim or retain it. And no price is big enough top pay in that pursuit. The rest of Kenyans are only roped along as supporting acts with the aroma of raw power suffocating the background. The Kalenjins are obtusely bitter after Kibaki’s orchestrated resolve to cut them to size during his first term as president. On the other hand the Kikuyus are cursing in arrears Moi’s determination to incinerate their hitherto political and economic advantage.
Kibaki’s penchant to resort to the tried and tested political games dolled in stereotypes became his Achilles heels. Kenyans know what they want and they are determined to get it at whatever price. The era of using power to selective reward and punish is gone and the sooner the dinosaurs knew that the better.
No amount of impunity will cow a determined populace to regain their right to choose the way they are governed. Only a new constitution reflecting institutionalized governance will save us from the brink of Armageddon. All else is pretence whose only success in guaranteed in postponing the inevitable. No wonder Justice Waki's wisdom informed him to ignore the sovereignty balderdash by handing over the secret envelope toDr Kofi Anna. -

SCHEDULE OF ALLEGED PERPETRATORS
CAUTIONARY STATEMENT
The Kenya National Commission on Human Rights (KNCHR) recognizes the existence of the culture of impunity in Kenya and the need to remove this shield. In the preceding chapters of this report, the KNCHR has made key recommendations including calling upon the Attorney General of the Republic of Kenya and/or the Kenya Police Force to undertake further investigations on various issues that the Report raises. In this section, we provide a list of alleged perpetrators, who were mentioned by interviewees as having played a role in the perpetration of the post election violence. The list is not comprehensive and does not present a complete picture of all who may have been involved. It makes mention of various alleged perpetrators and includes some background information on them, and the allegation(s) and information supporting the allegation(s), which the National Commission believes provides a basis and a good starting point for further investigations.
Every effort has been made to ensure that the information supporting the adverse mentions reaches a threshold that had been agreed to (see Page 20 in Chapter One).
The National Commission is not making any conclusions that the persons mentioned here are guilty; this is presented in the effort to remain faithful to hundreds of Kenyans who provided this information which we expect that the relevant agencies will further
investigate.
On many occasions unsuccessful efforts were made to contact those mentioned. In particular, given that this was election related violence, the Commission sent out letters to all the members of parliament, which however elicited very few responses.
The list was subjected to review by independent persons at the different stages of compiling the report including by the staff and commissioners as well as by national experts contracted by the National Commission to review the report and critique the same.

On the third week of January 2008, she attended a purported peace meeting at Manaret Society, and incited the local community after which a vicious attack against the Kisiis was instead intensified.
Together with Franklin Bett they talked to and incited about 700 youths at the Sotik Tea Estate and immediately they left the youths began to burn houses belonging to Kisiis.

During a public meeting in Kiptororo in Kuresoi in December 2007, he reportedly urged the Kalenjins to fight the Kikuyus until they leave Molo area.
Before elections, he and other prominent politicians attended a meeting in the interior Ndoinet forest. After the said meeting, the group that attended attacked and destroyed properties belonging to the non Kalenjins. It is believed that they incited the locals to attack non Kalenjins.
He brought young men (boys) in groups of more than 300 from Bomet who worked with the Luo locals to attack the Kikuyus.
Together with the late Kipkalia Kones and the late
Kimutai Too they financed the Kalenjin youths who
attacked the Kikuyus and Kisiis in Kericho.
He organized youths to attack the Kikuyus and
Kisiis in Kericho. He gave them transport, fuel and
food and held meetings at Kericho Tea Hotel and
other places.
He told supporters that “all the investors in
Kericho and in the estates will be either Kalenjins
or Indians”. This statement is said to have given
the youths motivation to attack all other tribes
especially Kisiis and Kikuyus.
He is said to have been explaining to people who
attended a meeting at Kipkatet that no one can
take what belongs to the Kalenjins, especially land.
In a meeting held in Chopkoibet in Bomet, he is
quoted to have said that “ he will beat up the
Kikuyus till they leave Molo”
Together with the late Kipkalia Kones and the late
David Too, they organized and facilitated the
youths to be transported from Trasmara and
Bomet by lorries through Silibwet to go and chase
Kikuyus from Kuresoi.
He intimidated people at Kericho Police Station
and told them that those that give information to
investigators on post election violence will be
lynched.
Eye witnesses have reported that on the 30th of
December 2007 at around10.00 am, at the Caltex
Petrol Station in Kericho town, he gave
unspecified amount of money to some Kalenjin
and Luo men who immediately after the said
payment started stoning and burning kiosks
perceived to be owned by Kikuyus but were in
actual fact owned by the Kipsigis and the Kisii
people.

On the 23rd November 2009 went to Stagemart in
Kericho and addressed a crowd asking residents to
remove all the stains/spots (madoadoa) from the
region. In January 2008 he asked that all the
stains/spots (Madoadoa) be removed from the
region.
Together with Kipkalia Kones and Franklin Bett
they financed the Kalenjin youths who attacked
the Kikuyus and Kisiis in Kericho.

5. Hon William Ruto MP, Eldoret North Constituency,
Minister
Planning, incitement, and
financing the violence
In August 2007 he held a meeting with other
senior ODM leaders in Kipkelion near Kericho
including Sotik MP the late Lorna Laboso , the late
Kipkalia K. Kones (Bomet), Kiprono L. J. Magerer
(Kipkelion) , and Franklin Bett (Bureti) where the
leaders resolved to carry out mass evictions of
non Kalenjins from ‘their’ Rift Valley areas,
particularly the Kikuyu and Abagusii.
During an opening ceremony for the Seventh Day
Adventist Church in a place called Mailing, he is
alleged to have said that they would uproot the
“sangari”, ‘shake off the soil’, ‘gather it together’
and ‘burn it’, in reference to ‘outsider’
communities. .
He is alleged to have addressed the public at
Bisabol shopping centre in Turbo near Burnt
Forest and incited the local Kalenjin and Luhya
communities against the Kikuyu.
At a meeting on 22/12/2007 at his home in Sugoi
said that his headache was Mr Jonathan Bii, his
opponent, who supported Kikuyu on the land
issue and directed that they should be attacked if
they dared campaign in the areas.
6. Hon. Boaz Kaino MP, Marakwet West constituency Inciting vioelence.
At a meeting, he said that he would remove
Kikuyu and Kisiis from the area after elections.

Ntimama reportedly incited the Maasais in Narok

On or about 30 December 2007, the Narok market
was burnt and several people injured after he
allegedly told Kalenjin and Maasai youths that the
Kikuyu women in the market had insulted him.

Kalenjin parents to withdraw their
children from Sirikwa Primary and
Secondary Schools. As a result the
Secondary school was reportedly closed
down.
32. Joseph Rotich a.k.a Survivor. Ass. Chief of Mawingu sublocation

He severally threatened the Kikuyu
residents in his area that their time was
running out and that they would be taken
back to central province. On 4/10/07, he
was said to have publicly told the
residents of Murinduko farm that the
Shopping center would be burnt down
soon. After two days, there was an attack
at Murinduko Trading Center by Kalenjin
raiders but they were repulsed by the
Kikuyus. A month later (25/11/07), there
was a major attack in Murinduko during
which two elderly people were killed by
Kalenjin raiders. When Murinduko center
was finally razed down on 16/1/08, Mr.
Rotich was spotted among the raiders
near Set Kobor farm. After the Trading
Center was burnt, Murinduko residents
fled. Mr. Rotich was reportedly heard
bragging that his word that the Kikuyus
were going to move to Central Province
had been fulfilled. He said that he was
going to ensure that all Kikuyus fled to
Kiambu and Nyeri.

killed by the police. The police then
proceeded to Chumba’s house where
they reportedly found a group of raiders
preparing to take tea which had been
prepared using big sufurias (cooking
pots). It is alleged that the police found a
dead body in the house. Chumba and the
raiders were arrested but were shortly
released reportedly upon the
intervention of Hon Moses Cheboi.

youths gathered outside Tito’s shop. They
later threatened the witness and crossed
over to the neighbouring Murinduko
farm and began attacking Kikuyus who
were attending to their farms, killing two
elderly people.

spotted meeting at his residence.

between 11.00am to 1.00pm at a Mr.

The Cummulative Steep Price of Electoral Theft

The Waki report is one document that will not fade from our national radar in a hurry. It has rattled many political interests and true to Kenya’s tradition expediency has taken centre stage with the two major political camps swapping positions. In the process more heat is generated leaving no trace of light in the whole process.
The Hague Express is patiently waiting to be flagged off with nobody ready to board. Well, they may not willingly board but all the kicks won’t deter ICC from claiming its scalp when the right time comes. The stakes are high and the two principals are held hostages by their sub-principals whose are hands are believed to hold the political asset of votes. So who will blink first?
Kibaki cannot afford the unforgivable and politically blasphemous act of dragging Jomo’s name in murk. With Jomo Jr topping the list in Waki’s envelope, leaving him exposed to face the laws of nature and vultures amounts to Kibaki aiding communal political suicide. The tower of Babel and economic hegemony thriving on his presidency would crash tumbling down like a pack of cards. Jomo’s skeletons must be rattling next top Parliament building at the prompting of the worms threatening to escape the can enmasse.
Then enter Bill Samoei and the stakes hit the skies. To him Waki’s margin of error is so large that he missed the boat by a whole river. And true to Kenya’s time tested gimmicks he has the Rift Valley brigade breathing fire with flaming brimstone. Now Waki’s report has been trivialized into a mere list hosted in an envelope.
Postponing inevitable apocalypse
With State House named as a principal address where the massacres were planned, can Kibaki afford to place his own head on the chopping block? And while at it, can Raila afford top purchase the politically expensive option of doing what is right no matter the fallout? Well, your guess is as good as mine and Kenya’s history bears us out. We haven’t seen anything yet.
The truth is that the present political theatrics are mere motions cleverly crafted to create impressions of movements. We have been up these roads and our smart politicians are aware of our naivety and short memory. Not this time. The average Kenyan is in such a foul mood and the world has changed so much so that Kenya will never be the same.
Even such high-sounding calls for a Truth, Justice and Reconciliation Commission will be clearly seen for what it is smokescreen to buy time. The lives of over 1500 Kenyans were not lost in vein. The masks are off and the politicians may thumb their chests all they want but the cheap tribal games are definitely over. They will only succeed in postponing the inevitable.

Superlative Impunity Galore

So Justice GBM Kariuki steps out of his official (tax payers) Mercedes Benz and engages his primitive instinct to stab Robert Karori in the stomach and still keeps his job as dispenser of justice? Some things can only happen in Kenya. But again IMPUNITY has become our middle name as a country.
It will come as no surprise to see people here predictably shouting presumed innocent till proven guilty. Being a High Court judge requires and demands purity and clarity of both character and thought. All the legal tribunal niceties only soothes egos at the expense of bloodying public opinion which is everything when it comes to matters judicial.
It takes superlative imagination to comtemplate an a robbed murderer convicting a petty thief in Kericho court tomorrow. Well, with the top leadership epitomizing impunity personified, Justice Kariuki is in safe company. The Chief Justice who is constitutionally mandated to write to Kibaki about Kariuki’s conduct and recommend a tribunal is himself a master of the same malice as evident in his midnight swearing in of the duly elected.

Civilized societies respect and remain sensitive to the court of public opinion. Thank God we have never even pretended to subscribe to membership of such a society. For industrious Kenyans that would be a needless pain that has no bankable rewards while you can auction a whole country as her citizen cheer you on. Deep Inside The Secret PNU And ODM Kitchens

While President Kibaki and Prime Minister Raila Odinga are busy telling Kenyans how the government of National Unity is solid and united, behind the scenes deadly daggers have been drawn and it is possible that very soon we will see some major turmoil on the political front.
Interestingly both sides of the political divide thing that they have outsmarted the other. I will reserve my controversial but well thought out verdict for the very end. After I have told you what they are saying and doing deep in the kitchens of PNU and ODM.
The plan now in the drawing boards of PNU insiders is to look for a way to put a spanner in the works to bring down the government of national unity. The motive is simple. They have carefully gone through the Anan laws with the help of lawyers and it is clear that in the event of the GNU collapsing Kibaki remains president and has the power to re-constitute a new cabinet. The PNU think tank s confident that they will be able to easily pull this one off because they say that they have well-documented evidence of corruption amongst the top ranks of ODM (more details in my raw notes to be released tomorrow). Interestingly ODM, as brilliant as their think tank is, has not been able to document much on the PNU side in terms of evidence on corrupt deals.
So the plan will be to leak the evidence to the public which I am informed will cause serious outrage and great disappointment even amongst ODM diehards.
The truth is that the Anan deal greatly favored PNU and ODM was short-changed in many ways. This is what PNU insiders are looking to cash in on.
It is not clear what the effect of the break up of the GNU would have on the general public. Most Kenyans are really sick of the current crop of politicians and Kenyan politics as a whole so the truth is that many will be delighted to see the GNU collapse. The only problem is that the alternative (a Kibaki cabinet) will not be acceptable to many. We know for instance that the warriors in Rift Valley have not disarmed. We also know that groups sympathetic to the PNU cause have been heavily arming and swore earlier this year never again to be caught unawares. That is the reality on the ground.
But as usual PNU insiders seem to have miscalculated and have probably not fully considered the repercussions of a re-constituted Kibaki cabinet.
As much as I have no love lost for the greedy selfish insensitive GNU, I shudder to think of what any alternative may bring.

Kibaki: Forgive My Criminal Negligence and Move On

Either Kibaki must have been religiously reading Kumekucha or thinking on the same wavelength as his apologists here. This may be the only way to reconcile his attempts to give national wings to the MOVE ON mantra. He started it over the weekend in Nakuru telling the IDPs to forgive and promptly made it the central plank of his Kenyatta day speech.
Ours is a country raped of any future and crying for direction from scoundrels with no BALLS to take challenges head on. Instead they perfect DECEPTIVE maneuvers to bandage national wounds that will surely consign us collectively to septic trauma. But you cannot blame nor envy Kibaki given the fact that Waki and Kriegler report both point fingers at two institutions at the heart of his fraudulent presidency. Before you shout stuck record please tell that Waki who has also chosen to address the cause and not cherry pick symptoms.
The heads of ECK and the police force are human and would not go down with a fight. The cupboard is full of skunks whose order is guaranteed to intoxicate all and sundry. The stinking details are too scary to imagine and faint hearts would better do with amnesty which they have been all hitherto opposing before the mask was removed from close buddies who schemed and financed murder of fellow Kenyans within the hallowed precincts of State House.
Kriegler may have been too cautious only sticking his neck on ECK. But not Waki who went the whole hog and looked the horse in the mouth and called it bluff in three apt words, IMPUNITY, IMPUNITY and more IMPUNITY. Expecting the same person who personifies impunity extraordinaire is not only naive at best but akin to recommending self-amputation of your very limbs at worst.
Unbreakable Hague noose
Poor Kenyans, we are stuck in a rut as we remain collectively hostage to poor, deceptive and fraudulent leadership whose singular agenda is to auction every facet of our country to the highest bidder. The supporting acts of Libyans have had their paycheck and so do Ugandans. Meanwhile Kibaki only remains comfortable with tried and tested fear of the unknown by selfishly cautioning that implementing Waki and Kriegler recommendations will plunge Kenyan into further into acrimony. For Pete’s sake we are at the bottom of the pit and we cannot fal any deeper.
Even Kofi Annan concurs that our problems are all rolled up in IMPUNITY and preaching forgiveness will only succeed in entrenching the same beast. We cannot afford the luxury of Moi-like hollow slogans of peace, love and unity. But thank God for small mercies. Waki must have foreseen the dithering and playing dice with Kenyans’ lives.
Waki's Hague option is not only LETHAL but a masterstroke and timeless too. Kibaki is better advised to act now when he can use incumbency to manipulate things in his favour. Gerrymandering will only see him plucked from Othaya to the Hague Charles Taylor style. Time is priceless and Emilio cannot buy in this case.

Mugoya Construction: The Sensational Comeback That Stinks

Remember Mugoya Constrution? Remember the numerous cases the company faced and even court appearances of the proprietor, Ugandan James Isabirye both in Kenya and his home country of Uganda?
Mugoya construction was also mentioned in the Kroll report and everybody knows how political connections and kick-backs were used to great effect to help the company look like it was the only construction company in Kenya at the height of the Moi era. In those days you just had to name any major project and Mugoya’s tentacles were sure to be there.
Now this house of evil has made a sensational comeback under the watch of the grand coalition government which some naïve Kenyans believe is clean because certain individuals whom they worship are in it.
A quick question for you. Why should a foreigner dominate construction projects in Kenya? Are there no qualified Kenyan companies? Or do we also have a Kenyan construction company dominating things in Uganda?
Let me take this opportunity to announce to Kenyans that Kibaki’s first government was much better and the corruption currently going on is making that administration even with Anglo Lasing hanging over it) look as clean as a Sunday school class. Folks, what is currently going on is a feeding frenzy. Most of your beloved politicians in the grand coalition government are very busy building war chests for the next general elections. They are in a terrible hurry because nobody believes that the next elections will be in 2012. Everybody knows that they will happen much earlier.
The amazing resurrection of Mugoya construction should tell Kenyans a lot. There is no doubt that it is linked to 2012 and the war chests being put together.
My sources tell me that Mugoya is involved in the Nairobi-Mombasa road project. Yes that major highway in Kenya that never seems to be completed although there is some semblance of work going on and construction is so slow that tourists have to shake their guts vigorously when going to Mombasa by road. Mugoya was squeezed into the project under very mysterious circumstances because another company has always been and still is the main contractor. Sources on the ground say that the company is building bus stops and taking care of other “special features” on the road. Wow!!!
I am also informed (and I am verifying this information) that Mugoya is very heavily involved in some hefty contracts in the Prisons department. In fact I am told that Mugoya are heavily hiring (casuals) at the moment. What all this means is that it is now business as usual at Mugoya.
How did this happen under the nose of the grand coalition government? I mean Kenyans are already reeling under the extremely heavy weight of supporting this bloated government and then these chaps are adding insult to injury with their corrupt ways. Where is the Prime Minister? Is there anybody who can stop the feeding frenzy currently going on and clearly illustrated by the return from the grave of Mugoya construction?

Waki Shames the Devil, Starts War on Impunity

Justice Waki has proved being Kenyan and having his fingers on the country’s pulse. While Kriegler skirted around the causes post election violence, Waki and his commissioners have not only named names but let a noose hanging precariously over the present kings of impunity.
At the heart of Waki’s recommendations is the resolve to address IMPUNITY as epitomized by Kibaki’s regime. Faint hearted Kibaki’s political apologists may not like it but reading Waki’s report leaves no doubt Kibaki is singularly to blame for his singular resolve to concentrate on bungling last year’s elections having known before hand the outcome.
That anything premised on DECEPTION is eternally unsustainable couldn't have proved more true. No amount of serial and shameless propaganda that Kibaki's cronies crafted to dovetail into tribal stereotypes will wash. The facts are stack and Waki has tactfully given Kibaki the leeway owing to FRAUDULENT incumbency to clear his act for a better Kenya.
The Hague option was Kibaki to fail in setting up a tribunal to try and punish IMPUNITY is not an empty threat. With daring Hague prosecutor Ocampo Moreno breathing fire on neighboring Bashir, the stakes couldn’t have been higher. Waki has expertly managed to juggle diplomacy in calling his appointing authority bluff without loosing sight and fidelity with the truth.
No more gimmicks
Waki has measured up to the calling and expectation in telling the king he is nude and not immaculately dressed as his cronies would want him to believe. But don’t count your chicks yet given Kenya’s reputation to defend the impossible. Soon we won’t be surprised when PNU troops start trumpeting Waki’s report as revenge act to his dismissal from the bench on corruption allegation which he successfully challenged before being reinstated.
Whatever the gimmicks, Waki has started the guillotining machine rolling downhill and beckoning our masters of impunity. By indicting our security agencies for their role in murdering people they are employed to protect, Waki has left no doubt where the buck stops.
Waki’s verdict disabuses us of the hitherto penchant to embrace anything from outside especially from the so-called whites. The die is cast and the reign of impunity is speedily hurtling to unceremonious and shameful demise thanks to Waki’s selflessness.
Time is ticking and soon there will be no corners (commissions) to cut. Waki's commission is like no other and the circumstances have dramatically changed. The cumulative wages of national sin is simply incalculable but somebody must pay. It only remains a matter of when and not if.
